Your attepmts to justify this to the people of the United States clearly outlined it for the enemy and those whom you're really spying on, so forget it. We might as well draft some legislature and follow the fucking rules. There.
Does Osama not know we're spying on him just because there's no law that "exposes the nature of the program?"
